Consent to electronic delivery of account statements: I hereby authorize Executive National Bank (“Bank”) to deliver correspondence and other communications (collectively “Communications”) including without limitation account statements, notices, check images, and other official documents required in connection with my Executive National Bank account to the email address I specify. I further authorize Executive National Bank to deliver to me any such Communication by sending me, in lieu of such Communication, a notice directing me to an address on the World Wide Web (“Web”) where the Communication is posted and from where it can be read and printed. Any such notice (hereinafter “Notice of Delivery by Web Posting”) will include the specific Web address whereon the Communication has been posted. I agree that the sending by Executive National Bank of a Notice of Delivery by Web Posting shall constitute good and effective delivery to me of the Communication whether or not I follow the instructions of the notice and actually access the Communication via the Web. The terms and conditions of the deposit agreements and disclosures for each Executive National Bank account as well as other agreements with Executive National Bank continue to apply notwithstanding anything to the contrary in this Agreement.
Periodic statement: Your enrollment into the e-Statements Program will automatically discontinue delivery of traditional printed statements. However, at any time you may request from Executive National Bank a paper copy of any record provided or made available electronically to you. If you wish for Executive National Bank to send you paper copies of any such documents, you will be charged a fee. Please refer to Executive National Bank’s Fee Schedule.
Required Hardware and Software: In order to access e-Statement and other electronic communication through online banking, you will need a device with internet access that meets Executive National Bank’s minimum software and hardware requirements. Please read the complete list of requirements on www.ExecutiveBank.com/browser-requirements. You are responsible for checking the link provided to make sure your system meets the requirements to access Business eBanking (BeB) and/or Personal Online Banking (CeB).
You are solely responsible for the installation, maintenance and configuration of hardware and software on your Internet Access Device for use of BeB or CeB. You are responsible for operating security procedures on the individual Internet Access Device with which you access BeB or CeB.
The Bank will not be responsible for the inability to access BeB or CeB for reasons beyond its control, including but not limited to: (a) the use of incompatible and/or deficient equipment or software; (b) problems associated with internet browsing software; (c) connectivity problems.
Termination or Withdrawal of Consent & Consequences of Changing your Mind: Either you or the Bank may terminate this Agreement or you may withdraw your consent to receive electronic records. If you withdraw your consent, your e-Statements service will be cancelled and periodic statements will revert back to printed statements. To cancel, provide a termination notice by postal mail, email or fax (reference contact information below) and the service will be terminated within 45 days.
Change of e-mail: You agree to immediately notify Executive National Bank of any change to your email address. You must provide the email change by postal mail, email or fax (reference contact information below) and the email address will be updated within 45 days.
Change in terms: The bank may change this Agreement at any time. Changes to this Agreement will become effective immediately, unless applicable law requires the Bank to give you advance notification. Changes that require advanced notification will become effective at the time of the notice or upon the date stated in the notice as required by applicable law. If the changes result in increased fees or liability to you, the Bank agrees to provide consumer accountholder notice at least thirty (30) days prior to the effective date. Assignment: Executive National Bank can assign its rights and delegate its duties under this Agreement to a company affiliated with Executive National Bank or to any other party. You may not assign your rights or duties to anyone else.
Warranties: IN NO EVENT WILL EXECUTIVE NATIONAL BANK OR ITS SUBSIDIARIES, AFFILIATES, CONTRACTORS, OR THEIR RESPECTIVE EMPLOYEES BE LIABLE UNDER ANY CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHER CLAIM FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM THE USE OF OR THE INABILITY TO USE e-STATEMENTS OR ANY PRODUCTS OR SERVICES, OR ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, EFFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, LINE SYSTEM FAILURE, LOSS OF DATA, OR LOSS OF USE RELATED TO THIS ELECTRONIC TRANSMISSION OR ANY WEB SITE OPERATED BY ANY THIRD PARTY.
Joint Account: If this is a Joint Account, you warrant that you are authorized to enter into this agreement on behalf of all accountholders. Each accountholder agrees that notice to any joint owner shall be deemed to be notice to all account holders. Each joint owner agrees that he or she shall be jointly and severally liable for the Account. Executive National Bank reserves the right to require written instructions from all account holders.
EFT Error Resolution Procedures Disclosure for Commercial /Business Accounts accessed through BeB or CeB: You must promptly review your electronic statement and any accompanying items. If you allow someone other than you to review your statements, you must still review the statement for any errors, unauthorized signatures, lack of signatures, alterations, or other irregularities. Please refer to ENB’s Terms and Conditions disclosure (Section entitled “Statements”) provided to you during the new account opening process. You may also contact the Bank at the address or telephone number indicated in this agreement.
EFT Error Resolution Procedures Disclosure for Consumer/Personal accounts accessed through BeB or CeB: Telephone the Bank at (305) 274-8382. Write to the Bank at 13450 SW 126 Street Bay # 12, Miami, Florida 33186; or E- mail the Bank firstname.lastname@example.org as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on your statement or receipt. Executive National Bank must hear from you no later than 60 days after the Bank sent the FIRST statement on which the problem or error appeared.
If you tell the Bank orally, the Bank may require that you send your complaint or question in writing within 10 business days. The Bank will determine whether an error occurred within 10 business days after the Bank hears from you and will correct any error promptly. If the Bank needs more time, however, the Bank may take up to 45 days to investigate your complaint or question. If the Bank decides to do this, the Bank will credit your account within 10 business days for the amount you think is an error, so that you will have the use of the money during the time it takes the Bank to complete our investigation. If the Bank asks you to put your complaint or question in writing and the Bank does not receive it within 10 business days, the Bank may not credit your account.
For errors involving new accounts, point-of-sale, or foreign-initiated transactions, the Bank may take up to 90 days to investigate your complaint or question. For new accounts, the Bank may take up to 20 business days to credit your account for the amount you think is in error. The Bank will tell you the results within three business days after completing our investigation. If the Bank decides that there was no error, the Bank will send you a written explanation. You may ask for copies of the documents that the Bank uses in our investigation.
Acknowledging your access and consent to receive documents electronically: By clicking the “I Agree” button you are confirming you can access this agreement electronically and that you were also able to access your e-statement. Until and unless you notify Executive National Bank, you consent to receive documents that are made available to you electronically throughout your relationship with the Executive National Bank.
